Job Summary

At the direction of the General Counsel, act as the College’s Privacy Official for the purposes of HIPAA and other relevant data privacy compliance requirements. Work independently on a wide range of legal matters including open records, data privacy, policy development and review, contracts, affiliation agreements, real estate, and gifts and estates.

Essential Duties

Drafting, reviewing, and editing contracts including affiliation agreements and gift agreements.

Managing, coordinating, and reviewing all responses to open records requests and subpoenas.

Review proposed changes to TCC policy and suggests appropriate updates to policy accordingly.

Build a strategic and comprehensive privacy program that defines, develops, maintains and implements policies and processes that enable consistent, effective privacy practices which minimize risk and ensure the confidentiality of protected health information (PHI), paper and/or electronic, across all media types. Ensures privacy forms, policies, standards, and procedures are up-to-date in compliance with HIPAA (the Health Insurance Portability and Accountability Act of1996), FERPA, GLBA, GDPR and relevant state laws as applicable. Works with senior management, to establish governance for the privacy program. Manages all required breach determination and notification processes under HIPAA and applicable State breach rules and requirements. Establishes and administers a process for investigating and acting on privacy and security complaints.

Oversee the legal aspects of real estate transactions, including preparation and review of legal documents relating to real estate, and negotiate the terms and conditions of real estate transactions.

Researches nationwide higher education best practices, including those identified by the National Association of College and University Attorneys (NACUA) and makes recommendations to the general Counsel on reduction of legal risk through potential improvements to programs and operations.

Performs related duties as assigned by the General Counsel.

Minimum Qualifications

Juris Doctorate degree from an ABA accredited law school.

Three years of relevant experience at hiring.

Knowledge of higher education laws and regulations, general processes, procedures, and internal and external constituencies.

Knowledge of the legal environment in the state of Oklahoma.

Advanced knowledge of contracting principles, including developing, drafting, revising, interpreting, and negotiating contract terms; and conducting contract risk assessments.

Strong working knowledge of contract formation and contract administration functions.

Proficiency with word processing, OSCN, Westlaw, E-discovery software, spreadsheet, database, and presentation software.

Preferred Qualifications

Three years experience working in a university/college setting and providing legal advice regarding employment, contracts, student issues, governance, constitutional law, civil rights, policy development and review, open records, privacy, law enforcement, litigation, risk management, tax, tort, public-private partnerships, employee benefits, construction, real estate, intellectual property, information technology, information security, healthcare, immigration, and ethics/conflicts of interest.

One year experience working on government or state agency contracts.

Three years experience with litigation and/or dispute resolution.
