Summary Description::

SUMMARY DEFINITION: Serves as the District’s compliance coordinator and investigator on assigned legal compliance issues Including Equal Employment Opportunity, Equity and Compliance Programs. DISTINGUISHING CAREER FEATURES Coordinates the District’s Equal Employment Opportunity (EEO), Equity and Compliance programs. SUPERVISION RECEIVED AND EXERCISED Receives direction from the Executive Director of Human Resources and Employee-Employer Relations or designee of the Vice Chancellor of Human Resources. Exercises functional guidance over technical and clerical support personnel if assigned.

Education and Experience Guidelines::

Any combination of education and experience that would likely provide the required knowledge and abilities is qualifying.

Education/Training::

Bachelor’s degree from an accredited college or university with major course work in human resources management, business or public administration, social work, psychology, forensic psychology or related field. A Master’s Degree with emphasis in human resources, law, business or public administration, social work, psychology, forensic psychology, higher education administration or related field is desirable.

Experience::

At least four years of increasingly responsible professional human resources experience, involving employee relations, training and investigation/resolution of discrimination and harassment complaints, in a public education setting, including at least two years of increasingly responsible legal compliance work. Victim advocacy training and experience is desirable.

License or Certificate::

Valid California driver’s license.

Work Environment::

Standard office setting. Typically, duties are performed in an office environment while sitting at a desk or computer workstation. Incumbents are subject to contact with others, frequent interruptions, noise from talking or office equipment and demanding legal timelines. At least minimal environmental controls to assure health and comfort. Must be able to adapt to changing situations and demanding timelines.

Physical Demands::

Incumbents regularly sit for long periods, walk short distances on a regular basis, travel to various locations to attend meetings/workshops and conduct investigations, use hands and fingers to operate an electronic keyboard or other office machines, reach with hands and arms, stoop or kneel or crouch to file, speak clearly and distinctly to answer telephones and to provide information; see to read fine print and operate computer; hear and understand voices over the telephone and in person; and lift, carry, and/or move objects weighing up to 10 pounds.

Position Specific Benefits::

Duties and Responsibilities:

LEADERSHIP Support the District’s commitment to an open, diverse, and inclusive working environment by investigating related complaints and recommending corrective actions, providing guidance and training to faculty and staff, building internal and external relationships leading to improved results, and conducting assessments of the effectiveness of District’s policies, procedures, and administrative requirements related to EEO, Equity and Compliance Programs.

Duties and Responsibilities:

INVESTIGATIVE COMPLIANCE 1. Receive, process, investigate and respond to complaints and grievances from employees, and third parties regarding EEO issues.

2. Process inquiries and discrimination complaints from the colleges and third parties in a timely manner; provide background information for use by external investigators or legal counsel.

3. Develop investigation plans for each complaint; notify and interview complainants, respondents, and witnesses.

4. Conduct research and investigations and grievance sessions to determine resolutions according to federal and State laws, District policies, practices, procedures, and applicable collective bargaining agreements to attempt to resolve alleged discrimination.

5. Conduct investigations or work with third party neutral fact finders to conduct investigations.

6. Counsel employees as appropriate.

7. Prepare recommendations for appropriate corrective action and issue factual findings and recommendations, as necessary.

8. Prepare and propose District case positions/responses regarding compliance, discrimination, equity, discipline, or grievance issues; and coordinate legal matters with District’s legal counsel as directed.

9. Obtain, review, and analyze relevant facts and documents related to reported incidents and determine a resolution or assess whether a further review or investigation is necessary to ensure the safety of the impacted student and the community; make recommendations and coordinate appropriate interim and remedial measures.

10. Develop and prepare written comprehensive reports of investigation, statements, and findings of facts, conclusions, and recommendations.

Duties and Responsibilities:

COMPLIANCE GUIDANCE
1. Provide training and technical assistance to District personnel on local, State and federal laws, regulation, and District policies and procedures related to equal employment opportunity, equity and compliance.

2. Provide recommendations for training and outreach programs as well as changes to policies and procedures based on investigative findings.

3. Provide a fair and neutral process for all parties and guidance counseling to employees regarding rights and privileges in areas of assigned responsibilities.

4. Refer faculty and staff to resources for supplementary support during an investigation; monitor outcomes, identifying and addressing any patterns, and assessing effects of misconduct on the campus climate; and

5. Prepare and submit a variety of reports, documentation, proposals, recommendations, correspondence, and other materials, as required for internal use and for external federal and State agencies.

Duties and Responsibilities:

POLICY, PROCEDURES, AND ADMINISTRATIVE REQUIREMENTS
1. Review and evaluate the daily administration of assigned District-wide legal compliance programs related to equity and diversity, non-discrimination and discrimination prevention including staff development and training, according to District objectives, policies and procedures and other legal requirements.

2. Work with supervisor to develop, coordinate, organize and implement an overall legal compliance plan, policy and related procedures, protocols, and practices; direct, review, monitor and control all programs, services, activities, and operations related to that plan; and organize and maintain related records, reports and files.

3. Review and recommend proposed, new, revised, or updated District policies and procedures, ensuring legal compliance, including those involving equal employment opportunity, equity, diversity, and non-discrimination employment; ensure that policy changes are effectively communicated throughout the District, providing recommendations and/or instructions to departments to ensure regulatory compliance and adherence to District policies and requirements.

4. Review and evaluate the South Orange Community College District Equal Employment Opportunity Plan; assist Executive Director with ADA, including the ADA interactive process, services, policies, and procedures, in compliance with District, State and federal regulations; and develop and maintain diverse recruitment pools.

5. Stay current of issues, changes or updates concerning areas of assignment and related trends, investigations, regulations, and statutes; ensure the development and dissemination of information related to new or revised automated systems, requirements or regulations affecting those areas.

Duties and Responsibilities:

RELATIONSHIPS 1. Chair or serve on committees, task forces and other work groups; make presentations to employees and/or the public at various meetings; and conduct workshops to provide specialized information, as needed or as requested.
2. Coordinate external regulatory or legal inquiries into discrimination and misconduct issues with representatives of State and federal agencies and respond to complaints of unlawful discrimination or retaliation.
3. Provide technical expertise concerning assigned areas of compliance, including discrimination, equal employment opportunity, equity, diversity, and investigations; interpret, apply, and explain related laws, rules, regulations, policies, and practices.
