Job Description POSITION OBJECTIVE

The H-1B Specialist is primarily responsible for administration of the University's H-1B non-immigrant worker program. The Specialist will also be responsible for performing Tax Analysis as it applies to international faculty, scholars and other nonresident aliens employed by the university.

ESSENTIAL FUNCTIONS

    Administer the University’s H-1B non-immigrant worker program. Manage documentation for public access files, prevailing wage requests, labor condition applications, and petitions. Constantly monitor and coordinate with departments to ensure all petitions and supporting documentation are received for timely filing. Gathering information and responding to government requests for evidence (RFE) as needed. Create and manage a notification system of cases requiring action and designate daily schedule to meet all caseload requirements. Upkeep of Immigration Software (LawLogix). Responsible for I-9 verification and tax treaty determinations. Advise departments on permanent residence process (green card). Ensure all documentation, filing fees, prevailing wage requests, and review process is completed timely. Provide assistance to adjustment of status and consular processing applicants with related filings. Use Visual Compliance software systems to screen perspective candidates. (50%)Perform international tax analysis for employees. (15%)Interact with international faculty and staff regarding tax issues and inquiries via phone, email or walk-in visitors. Collect immigration documents and forms from international faculty and staff and enter data in system. Maintain immigration files for nonresident alien researcher, visiting faculty and staff. Data entry for student tax analysis purposes.Prepare other tax filings as required, such as 8233, W-9 etc. Maintain an appropriate schedule of filings.Review processes and policies related to information gathered/maintained for tax purposes and implement or recommend changes that may improve efficiencies and/or accuracy.Gather data from the foreign national to determine record status, tax treaty status, FICA tax status and immigration status.
Prepare detailed statistical reports for IHRS, university administrators, community organizations, and government agencies, as directed by supervisor. (5%)Serve as an Alternate Responsible Officer for the University’s Exchange Visitor Program. Assist the J-1 Specialist in providing expertise and counsel to nonimmigrant and immigrant workers as related to J-1s, including maintaining the Student and Exchange Visitor Information System (SEVIS) within the over the university’s office of immigration and human resources services (IHRS). (5%)Manage the tax treaty database, WindStar, and the corresponding tax treaty benefits. Prepare J-1 petitions as needed. (5%)Assist the Immigration Manager in providing expertise and counsel to nonimmigrant and immigrant workers as related to immigrant petitions. Prepare other nonimmigrant and immigrant petition applications as needed. (5%)Responsible for Immigration Department quarterly newsletter. (5%)Responsible for updating and maintaining accurate content on the Immigration website. (5%)Develop and maintain clear understanding of all university programs to hire and retain non-US workers and maintain up-to-date knowledge of tax regulations. (5%)

NONESSENTIAL FUNCTIONS

    Perform other duties as assigned by the immigration director or manager. (<1%)Since negligence or lack of knowledge will subject Case to fines and/or subject non-immigrants to deportation, there are no nonessential functions.

Department: Daily contact with office staff.

University: Daily contact with faculty and other university personnel.

External: Regular contact with alien workers. Occasional contact with federal agencies or third party attorneys.

Students: Regular contact with students.

SUPERVISORY RESPONSIBILITY

No direct supervisory responsibility.

QUALIFICATIONS

Experience: 1 to 3 years of combined immigration experience and international scholar/student data management experience or experience in data systems maintenance. Must have US Citizenship or lawful permanent resident in order to meet ARO/DSO reporting requirements. Prior responsibility as an officer or alternative officer for an exchange visitor program is preferred. Experience in non-profit area with higher education and/or immigration paralegal experience is a plus. Experience in tax a plus.

Education: Bachelor’s degree required.

REQUIRED SKILLS

    Must be sensitive to cultural differences and be patient with people who are not fluent in English and who are not comfortable with US experiences.Working knowledge of DOL, DOS, IRS, and USCIS regulations.Working knowledge of tax treaties and US tax law as it applied to nonresident aliens, nonresident alien tax reporting, and compliance issues are highly desirable.Advanced knowledge of Microsoft windows (Word, Excel, and PowerPoint) and Google Docs and other software applications such as LawLogix. Proficient in the use of the internet; prefer knowledge of HR information systems (i.e. PeopleSoft and/or Oracle HR database system).Ability to prioritize and plan work activities; uses time efficiently. Able to deal with frequent change, delays, or unexpected events. WORKING CONDITIONS

General office environment. Works around continuous interruptions generated by telephone and walk-in traffic; frequently works under narrow legal time frame for task completion; work may include stressful situations regarding foreign worker extensions, maintenance of status, and other federal regulations; and endures daily exposure to creative faculty and nonimmigrants.
