Primary Purpose of the Organizational Unit

The Department of Human Resources is currently seeking qualified and motivated candidates to consider for an EEO Consultant and Investigator.

The Department of Human Resources commits to the creation of an inclusive, collaborative, and responsive University by attracting, retaining, and developing a diverse community of talented individuals in support of the University’s mission. Under direction of the Director of EEO and AA, the EEO Consultant and Investigator responds to complaints associated with the University’s EEO investigations and Title IX involving students, faculty, staff, applicants, and visitors. When a complaint is filed, the EEO Consultant and Investigator will evaluate the complaint and take appropriate steps with regards to the University’s Administrative Procedures, Board Policies, and/or Title IX regulations. The EEO Consultant and Investigator acts as a neutral party in the investigation and provides a detailed, unbiased report to the Director of EEO and AA regarding the findings of the investigation. The EEO Consultant and Investigator coordinates and provides training for selection committees and other staff regarding laws, regulations, policies, and procedures for EEO, staff diversity, discrimination, harassment, and retaliation.

Position Summary

The EEO Consultant and Investigator will assist with policies, which prohibit discrimination, retaliation, and harassment based on any protected status, sexual assault or sexual violence, interpersonal (relationship) violence, stalking, and similar types of misconduct. The EEO Consultant and Investigator will assist with creating, implementing, and enforcing these policies on a day-to-day basis by sharing information about the policies, receiving reports of potential violations, coordinating measures that help protect safety and well-being, investigating reports, and managing hearings.

Minimum Qualifications

BACHELOR’S DEGREE AND TWO YEARS OF PROGRESSIVELY RESPONSIBLE PROFESSIONAL HUMAN RESOURCES MANAGEMENT EXPERIENCE; OR EQUIVALENT COMBINATION OF TRAINING AND EXPERIENCE. ALL DEGREES MUST BE FROM APPROPRIATELY ACCREDITED INSTITUTIONS.

Additional Required Certifications, Licensures, and Certificates

Prefer but not required:

PHR, SHRM-CP, EEODF, and Mediation Certifications

Preferred Qualifications

Five (5) to seven (7) years of directly related experience.

Alternate Option

Investigation and Response

Conducts professional investigations in response to complaints of discrimination, harassment, or retaliation and coordinate the interactive ADA process involving UNCG students, staff, faculty, applicants or visitors.
Writes comprehensive reports of investigations with findings of fact and recommendations.
Provides impartial consultation, conflict resolution, and problem solving in response to complaints and inquiries received from University community. In cases where an investigation is warranted, this position is responsible for following established procedures in conducting a comprehensive investigation.
May serve as a mediator for some situations in which conflict resolution is needed.
Maintains a collaborative relationship with relevant offices, including the Human Resources Employee Relations unit, the UNCG Police Department, Title IX office, and the Office of the General Counsel.
Conducts prompt, thorough, impartial, and equitable investigations of reports of Prohibited Conduct.
Keeps thorough, accurate, comprehensive records related to all assigned case investigations.
Ensures effective collaboration and communication with key stakeholders and partners.
Assists in responding to legal inquiries, such as requests for documents and interrogatories and participates in depositions and court hearings.
Advises officials, managers/supervisors, faculty and counsels employees on EEO matters.

Case Management and Assessment

Advises and collaborates with campus community partners, as appropriate, on the status of initiatives, case management trends, challenges, and concerns pertaining to discrimination, harassment, retaliation, and ADA compliance.
Organizes, manages, and tracks incidents in a case management database. Prepares annual statistical report(s) on the number, nature, and disposition of complaints of discrimination, harassment, retaliation, and ADA.
Tracks cases, data, and trends to identify patterns and make recommendations to address them.
Collects the relevant facts related to the reported Title IX incidents and, in collaboration with the Title IX Coordinator and approval of the Director of EEO and AA, assess whether a further review or investigation is needed to ensure the safety of the impacted student and the community.

Informs the University community of options and raises awareness of resources with respect to reporting and filing complaints.
Develops and presents training for selection committees and other staff regarding laws, regulations, policies, and procedures for EEO, ADA, staff diversity, discrimination, harassment, and retaliation.
Monitors and coordinates regulatory compliance with local, state and federal civil rights laws and regulations, including Title IX, ADA, Sections 504 and 508 of the Rehabilitation Act of 1973, the Clery Act, and Violence Against Women Act (VAWA).
Works in a collaborative process to develop and review related University policies and administrative procedures in accordance with legal obligations and best practices.
Ensures associated mandated reporting is completed.
Collaborates with employee groups to ensure that employees are aware of their options and resources with respect to reporting and filing complaints alleging unlawful harassment, sexual assault, sexual misconduct and relationship violence.
